The Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act, 2026 (H.R. 5371) has officially been signed into law.
A major change within this bill has closed the legal loophole that previously allowed the interstate shipping of cannabis seeds. Under the new law, cannabis seeds will no longer be considered a hemp product.
In the 2018 Farm Bill, cannabis seeds were legally classified as hemp because the seed itself contains less than 0.3% THC by dry weight. This loophole made it possible for companies like ours to safely and legally ship seeds across state lines.
However, H.R. 5371 reclassifies cannabis seeds as a marijuana product, solely because they originate from a plant that exceeds 0.3% THC. This single change ends national seed shipping as we know it.
What Does This Mean for You?
* Cannabis seeds can no longer be legally shipped via USPS, UPS, or FedEx.
* Receiving or shipping cannabis seeds may carry federal drug trafficking penalties.
